Data protection declaration
Unless stated otherwise below, the provision of your personal data is neither legally nor contractually obligatory, nor required for conclusion of a contract. You are not obliged to provide your data. Not providing it will have no consequences. This only applies as long as the processing procedures below do not state otherwise.
“Personal data” is any information relating to an identified or identifiable natural person.

Server log files You can use our websites without submitting personal data. Every time our website is accessed, user data is transferred to us or our web hosts/IT service providers by your internet browser and stored in server log files. This stored data includes for example the name of the site called up, date and time of the request, the IP address, amount of data transferred and the provider making the request. The processing is carried out on the basis of Article 6(1) f) GDPR due to our legitimate interests in ensuring the smooth operation of our website as well as improving our services.

Your data may be transferred to third countries outside the EU, in particular to Canada and the USA, and processed there. The EU Commission has issued an adequacy decision for Canada. Transfers are covered by an applicable adequacy decision or appropriate safeguards under Articles 46 and 47 GDPR, in particular the European Commission’s standard contractual clauses and Shopify’s approved binding corporate rules where applicable. Details and copies of the safeguards are available through Shopify’s data processing terms and binding corporate rules.

Customer account Orders

Customer account
We process the account and contact details you provide to create and operate your requested customer account, authenticate sign-ins and make order information available (Article 6(1)(b) GDPR). Data used to protect accounts and prevent misuse is processed on the basis of Article 6(1)(f) GDPR; our legitimate interest is the security of the shop and customer accounts. Collection, processing, and transfer of personal data in orders When you submit an order we only collect and use your personal data insofar as this is necessary for the fulfilment and handling of your order as well as processing of your queries. The provision of data is necessary for conclusion of a contract. Failure to provide it will prevent the conclusion of any contract. The processing will occur on the basis of Article 6(1) b) GDPR and is required for the fulfilment of a contract with you. Your data is transferred here for example to the shipping companies and dropshipping providers, payment service providers, service providers for handling the order and IT service providers that you have selected. We will comply strictly with legal requirements in every case. The scope of data transmission is restricted to a minimum.

Your data may be transferred to third countries outside the EU, in particular to Canada and the USA, and processed there. The EU Commission has issued an adequacy decision for Canada. Shipping companies
Shipping and delivery notifications
We disclose your name, delivery address and necessary order details to the carrier and to service providers that create shipping labels and arrange delivery, including DHL and easyDHL. The legal basis is Article 6(1)(b) GDPR. Contact details are supplied where necessary for the selected delivery service. Additional optional tracking notifications that require consent are based on Article 6(1)(a) GDPR; you can withdraw that consent for the future.

Payment service providers
Depending on your selection at checkout, payments are processed through Shopify Payments and its payment processors, PayPal (Europe) S.à.r.l. et Cie, S.C.A., Klarna or the provider of the wallet or local payment method selected. This may include Shop Pay, Apple Pay and Google Pay. We disclose the transaction, contact, billing and payment information necessary to process the chosen payment under Article 6(1)(b) GDPR. Providers may process information as independent controllers to meet their own legal obligations and prevent fraud. Deferred-payment or instalment providers may check eligibility or creditworthiness; details, including any automated assessment, are provided by that provider before the payment method is used. Read the applicable notices at Shopify, Shopify Payments processors, PayPal and Klarna. We do not receive your complete card details when the payment provider processes them directly.

Analysis

Use of Shopify Analytics
We use the statistical and analytical functions of Shopify International Ltd. (Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland; "Shopify") on our website as part of an order processing. Shopify is an affiliated company of Shopify Inc. (151 O'Connor Street, Ground Floor, Ottawa, Ontario, K2P 2L8, Canada).
The processing of data serves to analyse this website and its visitors. For this purpose, data is stored for marketing and optimisation purposes and provided in reports, analyses and statistics. In the process, the following device information is collected and processed, among others: Web browser information, IP address, time zone and some of the cookies installed on your device. When you navigate the website, information is also collected on websites or products accessed, the referrer URL (website from which you accessed our website), and information on how you interact with the website. This is done using technologies such as cookies and web beacons, tags and pixels (electronic files that collect information about how you navigate the website).
The use of cookies or comparable technologies is carried out with your consent on the basis of Art. 25 Para. 1 Sentence 1 TDDDG in conjunction with Art. 6 Para. 1 Letter a GDPR. The processing of your personal data is carried out with your consent on the basis of Art. 6 para. 1 lit. a GDPR. You can withdraw your consent at any time without affecting the legality of the processing carried out with your consent up to the withdrawal.
You can find more detailed information on data protection at Shopify at https://www.shopify.com/de/legal/datenschutz, information on the order processing agreement at https://www.shopify.com/de/legal/dpa and information on the cookies used at https://www.shopify.com/de/legal/cookies.

Business registration and VAT verification

We use Shopify Forms and our customer account system to collect business and contact details, VAT identification numbers and the information needed to review a business-account application. Business evidence sent to us by email is used for this manual review and, where necessary, to substantiate the tax treatment of transactions. The legal bases are Article 6(1)(b) GDPR for your application and business relationship, Article 6(1)(f) GDPR for our legitimate interest in preventing misuse, and Article 6(1)(c) GDPR for tax obligations. Required information is identified in the form; without it we cannot review the application. VAT exemption is not granted solely by entering a VAT number. Application records are kept only as long as needed for review, account administration, legally required evidence or the establishment, exercise or defence of legal claims.

Newsletter and back-in-stock notifications

If you subscribe, we use your email address and the preferences you provide to send the newsletter or the specific product-availability notifications you requested. The legal basis is your consent under Article 6(1)(a) GDPR and, for email marketing, section 7 UWG. We use Shopify’s email services and the Mission Gear Pro Restock app to manage these requests. A back-in-stock request does not by itself subscribe you to general advertising. You can withdraw consent at any time using the unsubscribe option in a message or by emailing us. Consent and withdrawal records may be retained to demonstrate compliance; a limited suppression record may be kept to respect your objection. Statutory exceptions for advertising to existing customers apply only where their requirements are met.

Chat, support and online withdrawal

We use Shopify Inbox for shop chat. Your messages, contact details and relevant order information are used to answer your enquiry under Article 6(1)(b) GDPR, or Article 6(1)(f) GDPR for other enquiries; our legitimate interest is effective customer support. The public withdrawal form is provided through the EU Widerruf Button app. The name, email address, order-identification details and declaration entered there are processed to receive and acknowledge your withdrawal and handle the contract under Article 6(1)(b) and (c) GDPR. You can instead contact us by email or post. Messages and withdrawal records are retained for the relevant processing, statutory documentation duties and any necessary defence of legal claims, then deleted.

Connected sales, analytics and advertising services

Our connected channels and apps include Google & YouTube, Facebook & Instagram, Microsoft’s Growth Agent service and ChatGPT. Depending on the channel or function used, relevant service providers may receive device and browser identifiers, pages viewed, product interactions and checkout or purchase events to operate the integration, measure activity or provide advertising functions. Recipients include the relevant Shopify service and the channel provider, including Google, Meta, Microsoft or OpenAI. Processing necessary for a service you request is based on Article 6(1)(b) GDPR; security and administration on Article 6(1)(f) GDPR. Optional analytics, advertising cookies and comparable tracking require your prior consent under section 25(1) TDDDG and Article 6(1)(a) GDPR. Consent settings also govern eligible server-side marketing data sharing. You can manage your choices through the shop’s cookie banner and privacy settings. Provider information: Google, Meta, Microsoft and OpenAI.

Shopify Network Intelligence

Shopify Network Intelligence is enabled. This allows Shopify to use data from interactions with our shop together with data from other Shopify services and merchants to support fraud prevention, service improvement, personalisation and eligible advertising functions. For processing it undertakes for its own purposes, Shopify acts as an independent controller. Optional personalisation and marketing are subject to the applicable consent choices and legal requirements. See Shopify’s consumer privacy notice and Shopify’s privacy portal for the relevant purposes, legal bases and rights.

Reviews

Our website links to Trustpilot and loads its display component. When that component is requested, technical data such as IP address and browser information is transmitted to Trustpilot to deliver it. Display without optional tracking is based on Article 6(1)(f) GDPR; our legitimate interest is informing customers about independent reviews. Any optional tracking requires prior consent. If you follow a review link, the provider processes data under its own notice. For Google Customer Reviews, you can choose after ordering whether Google may email you a survey. Only if you agree do we send Google your order number, order email address, delivery country and estimated delivery date (Article 6(1)(a) GDPR). You may refuse or withdraw consent for the future. See Trustpilot’s privacy notice and Google’s privacy notice.

Retention, recipients and your choices

We use hosting, IT, communication, payment, shipping and support providers only for the relevant purposes and under data protection agreements where required. We delete or anonymise data when the relevant purpose no longer requires it, subject to legal retention and limitation periods. Invoice and accounting records are generally kept for eight years, business correspondence for six years and records subject to a ten-year tax retention duty for ten years, calculated under the applicable law. Longer retention may be required by pending proceedings. Account, application and marketing data follows the purpose-specific criteria above. Consent can be withdrawn at any time without affecting prior lawful processing. Where local law provides additional rights to opt out of data sharing or targeted advertising, use the privacy choices page. Shopify also processes recognised Global Privacy Control signals where applicable. We do not make business-account approval decisions solely by automated processing.

Rights of persons affected and storage duration

If the objection is successful, we will no longer process the personal data, unless we can demonstrate compelling legitimate grounds for the processing that outweigh your interests or rights and freedoms, or the processing is intended for the assertion, exercise or defence of legal claims.
